Welcome to The Roost Hole Guide Service. By booking a hunting trip or using our services, you agree to these Terms of Service. Please read them carefully.

1. Services Provided

The Roost Hole Guide Service provides guided waterfowl hunting experiences in Stuttgart, Arkansas, including:

• Guided duck and goose hunting trips
• Flooded rice field hunting
• Field spread hunting
• Layout hunts
• Optional lodging arrangements

2. Booking and Reservations

2.1 How to Book

Reservations must be made by phone at 870-830-3633 or via text message. Bookings are confirmed only after:

• Verbal or written confirmation from The Roost Hole Guide Service
• Receipt of required deposit (if applicable)

2.2 Deposits and Payment

Payment terms will be discussed at time of booking. All payments must be received before or at the start of your hunt.

2.3 Cancellation Policy

• Client Cancellation: If you need to cancel, contact us as soon as possible. Refund policy will be discussed at booking.
• Weather Cancellation: We reserve the right to cancel hunts due to unsafe weather conditions. In such cases, we will work with you to reschedule.
• Guide Cancellation: In rare circumstances, we may need to cancel your hunt. We will provide as much notice as possible and offer a full refund or reschedule.

3. Requirements for Hunters

3.1 Legal Requirements

All hunters must have:

• Valid Arkansas hunting license
• Federal migratory bird hunting stamp (duck stamp)
• Arkansas waterfowl stamp
• HIP (Harvest Information Program) certification
• Hunter education certificate (if born after January 1, 1969)
• WMA permit (if hunting on Wildlife Management Areas)

3.2 Age Requirements

• Hunters under 16 must be accompanied by an adult
• Youth hunters under 16 without hunter education must hunt with a licensed adult age 21 or older

3.3 Physical Requirements

Hunting requires:

• Ability to walk in uneven terrain and muddy conditions
• Ability to enter and exit blinds safely
• Ability to sit/stand for extended periods
• Ability to handle firearms safely

Please inform us of any physical limitations or health conditions that may affect your ability to hunt safely.

4. What to Bring

Hunters must provide:

• Shotgun (12 or 20 gauge recommended)
• Steel shot ammunition (non-toxic shot required by law)
• Appropriate hunting clothing (camouflage, waterproof)
• Waders or hip boots
• Hunting license and stamps (listed above)

We provide:

• Decoys and decoy setup
• Blinds
• Calling services
• Field knowledge and guiding

5. Safety and Conduct

5.2 Required Safety Practices

• Follow all firearms safety rules
• Obey all commands from your guide
• Identify your target before shooting
• Know your shooting zones and safe firing directions
• Never point a firearm at another person
• Keep firearms unloaded until ready to hunt
• Wear hunter orange when required

5.3 Prohibited Conduct

The following are strictly prohibited:

• Hunting while under the influence of alcohol or drugs
• Unsafe firearm handling
• Exceeding bag limits
• Shooting protected species
• Shooting outside legal hunting hours
• Disrespectful or aggressive behavior
• Damaging property

Violation of these rules may result in immediate termination of your hunt without refund.

6. Assumption of Risk

Hunting is an outdoor activity that involves inherent risks, including but not limited to:

• Firearm-related injuries
• Slips, trips, and falls
• Extreme weather conditions
• Wildlife encounters
• Insect bites and plant allergies
• Vehicle accidents

By participating in a guided hunt, you acknowledge and accept these risks.

7. Liability and Indemnification

7.1 Limitation of Liability

To the fullest extent permitted by law, The Roost Hole Guide Service, its owner, employees, and agents shall not be liable for any injuries, damages, or losses arising from your participation in hunting activities, except in cases of gross negligence or willful misconduct.

7.2 Indemnification

You agree to indemnify and hold harmless The Roost Hole Guide Service from any claims, damages, or expenses arising from:

• Your violation of these Terms of Service
• Your violation of any laws or regulations
• Your negligent or intentional actions
• Injury or damage you cause to others

8. Insurance

We strongly recommend that all hunters carry:

• Personal health/accident insurance
• Personal liability insurance
• Travel insurance (if applicable)

The Roost Hole Guide Service is not responsible for your medical expenses, lost or damaged equipment, or trip cancellations.

9. Arkansas Hunting Regulations

All hunters must comply with Arkansas Game & Fish Commission regulations, including:

• Season dates and bag limits
• Shooting hours (typically 30 minutes before sunrise to noon for ducks)
• Species identification and restrictions
• Non-toxic shot requirements
• Possession limits

It is your responsibility to know and follow all applicable laws. Violations may result in fines, license suspension, or criminal charges.

10. No Guarantees

While we strive to provide excellent hunting opportunities, we cannot guarantee:

• Specific numbers of birds harvested
• Weather conditions
• Wildlife behavior or migration patterns
• Specific outcomes or experiences

Hunting success depends on many factors beyond our control, including weather, migration timing, and hunter skill.

11. Photography and Media

We may take photos or videos during your hunt for marketing purposes. By participating, you grant us permission to use these images on our website, social media, and promotional materials. If you prefer not to be photographed, please inform us before your hunt.

12. Lodging (If Applicable)

If lodging is provided:

• You are responsible for any damage to the property
• Smoking is prohibited indoors (if applicable)
• Respect quiet hours and other guests
• Follow all property rules

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

14. Governing Law

These Terms are governed by the laws of the State of Arkansas. Any disputes shall be resolved in the appropriate courts of Arkansas County, Arkansas.

15. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes indicates acceptance of the updated Terms.

16. Entire Agreement

These Terms, along with any booking confirmation and additional written agreements, constitute the entire agreement between you and The Roost Hole Guide Service.

By booking a hunt with The Roost Hole Guide Service, you acknowledge that you have read, understood, and agree to these Terms of Service.
